"Merciless insurance companies use intimidation tactics to deter claimants from pursuing legitimate claims We recently have been unfortunate in having to submit a liability claim for an incident which happened at a McDonalds fast food restaurant in Sydney, NSW. Although the details of the incident were leaning in our favour, we were quick to learn that in the world of insurance, lie ruthless insurance officers, programmed and conditioned to scare off genuine victims placing rightful claims. They will exhaust you. They will intimidate you. They will try to discourage and deter you. Our simple claim, we were told, would be resolved based on wether the carpark was compliant or, as we disputed, non compliant. We were prepared, we researched and compiled our supporting documents. We had DA certification, Australian Standards, council support, NSW Roads and Maritime road rules, government urban infrastructure guidelines. All in our favour. What did KJ Risk Group have? Vicki Chen, Managing Claims Officer. And what did Vicki have? The “No Drive” zone. She confidently accused us of driving on a “prohibited zone”. After reading the NSW road rules, cover to cover. Much to my dismay, the “no drive” zone was non existent. She had fabricated a law, given it a formal name and made it official in her books. She then proceeded to use it to reject our claim. We confronted her and she immediately reworded her “No drive zone” claims. No hiding from that embarrassing and immoral act because we have the entire fiasco in writing. When she couldn’t get that to stick she was quick to move onto denying any issues with compliance ALTHOUGH The Australian standards specify CLEAR and concise guidelines to ensure safe structures (these are unavoidable, as I’m sure you are aware) and by simply understanding those, We proved that the incident involved a NON COMPLIANT carpark facility, which was the direct cause of the incident. Changes were ordered by the council. Changes were made. Vicki continued to deny the non compliance. Blatantly denied it. Vicki saw no relevance. In her level of expertise she was convinced that she had the power to override DA requirements. Vicki is neither qualified or has credentials to decide whether these structures meet compliance, and even after council confirmation, proceeded to dispute the Australian Standards. It takes a special kind of individual to deliver this type of company policy and procedures. These are just a taste of the vexatious defences we were dealt in our, less than pleasing, dealings with KJ Risk Group. So we wanted to share our experience with you, to give people the courage to stand their ground. Do their homework. The integrity and honesty of these “professionals” is always questionable. KJ RISK GROUP proudly advertise that they adhere to industry codes of practise. That’s disputable. I haven’t quite worked out whether they were determined to reject my claim, because it would appear that there is a conflict of interest, given they are a renowned Ronald McDonald Charities sponsor. To date, I have only ever had dealings with one company, KJ Risk Group, so I can’t confirm that all insurance companies employ these types of tactics. But people need to be wary, educate themselves. Their false confidence is a strategy they engage in hopes to deter claimants. Our claim continues to be denied. For reasons unknown. Interested to see how they explain this in court and to the media. It is at your discretion to exhaust McDonald’s funding however you see fit."
