"I attended this salon for my facials a number of times under the previous Management. The visits had been fantastic and without incidents until it was sold out to the new Management last year. I attended the business a few months ago under this new Management which i wasn’t altogether impressed with during my treatment. All the same I felt it useful to give it another try in line with supporting local business. I rang up yesterday to make an appointment over the phone. The Manager who called herself Leah advised I had to pay 50% deposit upfront to secure the appointment. And that I would receive a text msg to the effect. I said I had never had to pay a deposit of this sort to secure a facial appointment before to which she replied I was a repeat customer therefore it would be waived. As soon as the call ended I received a text msg providing me with two options.Option on the right said upfront payment of a 50% deposit to secure the appointment. And right on top of it details of my credit card with the word “saved” next to it. Option 2 was to call the business which I did the next morning. At approximately 9.20am this morning, I rang and again it was Leah who answered. I explained the situation and asked that my card details be deleted as I did not consent to them saving the details of my card on their system. She denied they had details of my card saved as the details could not be seen on my file. At 9.20am Saturday morning I did wonder what she was doing with my file when the appointment was made for the following week. I explained the evidence of Imani saving my card details on their system was clearly evidenced in the text msg I received yesterday as soon as the phone call to make the appointment was made. She continued to argue the point and reminding me no payment had been taken out. Strangely enough she failed to get the legality of the matter that it was a violation of the Privacy Act to be storing customer’s card details on their system without their consent and knowledge So I felt it best to cut to a chase and cited the Privacy Act and for that reason will not be returning … before I could even finished my sentence she slammed the phone on me! And they even had the audacity to allege I was verbally abusive to point customers in the shop could hear! The practice and the text msg received raised a number of concerns 1) the legality of storing confidential details of customer without their consent and knowledge 2) the legality of demanding an upfront payment of a 50%’deposit to secure a facial appointment - all of which was done in a text msg to the customer - black and white. No confusion there as I chose not to pay the 50% upfront deposit payment."
